Terms and Conditions

1.       Procedure and implementation of the competition

The organizer of the sweepstakes is Henkel AG & Co. KGaA, Henkelstraße 67, 40589 Düsseldorf, Germany (hereinafter "Henkel"). The giveaway periods lasts until 25.12.2021 at 11:59 PM CET; however, each individual giveaway closes at 11:59 PM CET on the date of the giveaway posting (postings will be made on December 2^nd, 5^th, 8^th, 11^th, 14^th, 17^th, 20^th, 23^rd). Late entries cannot be considered.

The competition will take place in the period from 01.12.2021 to 25.12.2021. There are a total of eight Nature Box Advent Calendar box sets. Each set contains (2) boxes of (3) select Nature Box products as advertised in the respective giveaway posting.

Entry into the sweepstakes is completed by commenting on the corresponding Instagram post. The winner will be selected by drawing lots. The winners will be notified privately after each giveaway day (2^nd, 5^th, 8^th, 11^th, 14^th, 17^th, 20^th, 23^rd) has concluded. The winners will be contacted via Instagram private messages. As soon as the winner has submitted his postal address, the prize will be sent by mail.

2.       Eligibility

All natural persons (Instagram users) who have reached the age of 18, have agreed to these terms and conditions of participation and have liked and commented the aforementioned post are eligible to participate, provided that they reside within the European Union. To participate in the competition, it is absolutely necessary that all personal details are true. Each participant can only take part in his/her own name. Employees of the supervising agency and of Henkel and its affiliated companies, as well as their relatives, are excluded from participation.

3.       Agreement of Customer / Use of posts

The participant must receive the consent of the person who is shown on any pictures, videos and that the pictures and videos are published in the internet (website and on social media channels) and submitted to the online competition.

4.       Exclusion of certain persons

If a participant violates these terms and conditions of participation, Henkel reserves the right to exclude that participant from the competition. Participants who use unauthorized aids or otherwise obtain advantages through manipulation will also be excluded. In such cases, Henkel may also subsequently withdraw and reclaim prizes.

5.       Premature termination of the competition

Henkel reserves the right to cancel or terminate the competition at any time without prior notice. Henkel will make use of this option in particular if, for technical reasons (e.g. viruses in computer systems, manipulation or errors in the hardware/software) or for legal reasons, it is not possible to guarantee that the game will be conducted properly. If such termination is caused by the conduct of a participant, Henkel may claim compensation from that person for the damage incurred.

6.       Prize and winner

The winner will be contacted by Henkel via Instagram private messages. If the winner does not respond within four (4) weeks after the prize notification has been sent, the claim to the prize will lapse and a new winner will be determined. If not redeemed within the time frame mentioned above, all vouchers expire. Only one prize is possible per participant, which cannot be paid out in cash as an alternative. Winning claims are not transferable to other persons. Henkel retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available.

7.       Liability

Henkel shall be released from all obligations with the award of the prize.

Henkel shall not be liable for any material or legal defects in the prizes provided by a cooperation partner and/or for the insolvency of the cooperation partner and the resulting consequences for the execution of the prize draw and the prize processing. Any claims are to be addressed directly to the cooperation partner.

Henkel shall be liable for defects of title and quality only in the event of intent or gross negligence.

Henkel shall not be liable for damage caused by errors, delays or interruptions in transmission, malfunctions of technical equipment and service, incorrect content, loss or deletion of data, viruses or in any other way during participation in competitions.

The limitations of liability shall not apply if the damage is caused intentionally or by gross negligence on the part of Henkel (its corporate bodies, employees or vicarious agents) or if a material contractual obligation is involved.

There shall be no liability for persons excluded under clause 3.

8.       Miscellaneous

Legal recourse is excluded. These terms and conditions of participation and the entire legal relationship between the participants and Henkel shall be governed exclusively by the laws of the Federal Republic of Germany. Should individual provisions of the terms and conditions of participation be or become invalid, this shall not affect the validity of the remaining terms and conditions of participation. The terms and conditions of participation may be amended by Henkel at any time without separate notification.

Data Protection

Henkel or a service provider commissioned by Henkel will collect and use the data provided by the participant to the extent necessary for the purpose of carrying out the prize draw. As this is necessary for the delivery of the prize or for the execution of the sweepstake, Henkel will also transmit personal data to third parties.

The processing and use of your data is based (1) on legal provisions that justify processing on the grounds that the processing is necessary for the implementation of the sweepstakes (Art. 6 (1) (b) DSGVO) and (2) on Henkel's legitimate interest in detecting and prosecuting abuse in the context of organizing the sweepstakes (Art. 6 (1) (f) DSGVO). We only store the data for as long as we need it to fulfill the above-mentioned purposes or for as long as is necessary to fulfill legal retention obligations.

You can exercise your right to information at any time. In addition, you have the following further rights if the respective requirements are met:

Henkel will stop the processing, unless Henkel can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims.
